Terms of Service

• "Account" means a unique account created for you to access the Service.
• "App Store" means Apple App Store, Google Play, or any other digital distribution platform through which you download FessBox or purchase a subscription.
• "Content" means text, images, messages, confessions, questions, prompts, replies, profile details, page details, reports, reply cards, exports, feedback, or other material submitted, generated, displayed, posted, or shared through the Service.
• "Creator" means a user who creates or manages a FessBox public page, inbox, prompt, reply, card, or related account.
• "Message Sender" means a person who submits a message, question, confession, or other content to a creator page.
• "Subscription" means a paid plan, entitlement, or in-app purchase that unlocks additional features.
• "You" means the individual or entity accessing or using the Service.

You must be at least 18 years old, or the age of majority in your jurisdiction if higher, to use FessBox. By using the Service, you represent that you meet this requirement and that you are legally permitted to use the Service in your jurisdiction.

If you use the Service on behalf of a business, brand, organization, or other entity, you represent that you have authority to bind that entity to these Terms.

You may need an account to use creator features. You agree to provide accurate, current, and complete information and to keep it updated.

You are responsible for maintaining the confidentiality of your account, device, and sign-in credentials. You are responsible for all activity under your account. Notify us immediately at support@fessbox.com if you believe your account has been compromised.

You may not use a username, page slug, display name, brand, trademark, or identity that you do not have the right to use, that impersonates another person or entity, or that is offensive, misleading, illegal, or likely to cause confusion.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, access, and use the Service for personal, creator, community, or internal business purposes.

You may not:

• Copy, modify, distribute, sell, lease, sublicense, or exploit the Service except as expressly allowed by these Terms.
• Reverse engineer, decompile, disassemble, or attempt to extract source code except where applicable law expressly permits it.
• Remove, obscure, or alter proprietary notices.
• Use the Service to build a competing product or service through unauthorized access, scraping, or copying.
• Interfere with, disrupt, overload, or compromise the Service or its security.

FessBox lets creators create public pages and prompts, collect audience submissions, manage a private inbox, reply to messages, generate shareable reply cards, use analytics, export inbox data, and access AI-assisted features.

Creators decide whether and how to share replies, cards, or other content outside FessBox. Message Senders understand that message content they submit will be delivered to the creator page they selected and may be reviewed, moderated, replied to, deleted, reported, blocked, exported, processed by AI features, or shared by the creator according to the Service and the creator's choices.

FessBox may allow Message Senders to submit messages anonymously. Anonymous submission means the creator normally does not see the sender's identity in the inbox. It does not guarantee that the sender can never be identified in any circumstance.

Message Senders should not include personal information in a message unless they are comfortable with the creator receiving it. If a sender identifies themselves in the content of a message, FessBox cannot make that content anonymous.

You retain ownership of Content you submit, subject to the rights granted in these Terms.

By submitting Content to the Service, you grant FessBox a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, process, modify for formatting or technical purposes, display, perform, distribute, transmit, create derivative works from, and otherwise use the Content as needed to provide, operate, secure, moderate, improve, promote, and support the Service.

This license includes the right to:

• Deliver messages to the relevant creator inbox.
• Display public creator pages, prompts, replies, cards, and public wall content where enabled.
• Process Content through moderation, safety, analytics, export, and AI systems.
• Generate previews, thumbnails, reply cards, summaries, tags, drafts, and related outputs.
• Share Content with service providers that help us operate the Service.

You represent and warrant that:

• You own or have the necessary rights to submit the Content.
• Your Content does not violate these Terms, applicable law, or anyone else's rights.
• Your Content does not include personal information of others unless you have a lawful basis and any required consent to provide it.

You are solely responsible for your Content and for the consequences of posting, submitting, sharing, or relying on it.

You may not use FessBox to submit, publish, request, promote, encourage, or distribute Content or activity that:

• Is illegal, fraudulent, deceptive, or misleading.
• Harasses, bullies, threatens, abuses, humiliates, doxxes, stalks, or exploits another person.
• Promotes hate, discrimination, violence, terrorism, extremism, or harm against protected groups.
• Contains sexual exploitation, child sexual abuse material, non-consensual intimate content, or sexual content involving minors.
• Encourages self-harm, suicide, eating disorders, dangerous challenges, or real-world harm.
• Is defamatory, invasive of privacy, or violates publicity, confidentiality, or data protection rights.
• Infringes copyright, trademark, trade secret, patent, or other intellectual property rights.
• Contains spam, scams, phishing, malware, unauthorized advertising, chain letters, fake engagement, or automated abuse.
• Attempts to reveal, buy, sell, infer, or misuse the identity of anonymous senders.
• Uses bots, scraping, automation, or rate-limit bypassing without our written permission.
• Interferes with the Service, probes security, bypasses access controls, or reverse engineers protected systems.
• Violates app-store rules, payment rules, platform policies, or applicable law.

We may remove, hide, restrict, or refuse Content that we believe violates these Terms, creates risk, or harms the Service or users.

FessBox may use human review, automated systems, AI moderation, keyword filters, rate limits, reports, blocks, and other safety tools. We do not guarantee that all harmful Content will be detected or removed.

We may, at our discretion:

• Reject, hide, remove, label, downrank, or restrict Content.
• Limit, suspend, or terminate accounts, creator pages, subscriptions, features, or access.
• Disable public pages or sharing features.
• Investigate reports and cooperate with law enforcement or regulators where appropriate.
• Preserve information where reasonably necessary for safety, legal, or enforcement reasons.

If you believe Content violates these Terms or your rights, contact support@fessbox.com with enough information for us to identify and review the Content. Where in-app reporting, blocking, deletion, appeal, or moderation tools are available, you may use those tools as well.

If we take action against your Content or account and you believe it was a mistake, you may contact support@fessbox.com to request review. We may not provide review where doing so would create safety, legal, security, or operational risk.

FessBox includes AI-assisted features, such as moderation, reply drafts, inbox summaries, inbox intelligence, message grouping, audience insights, recommended actions, and content repurposing.

You may not use AI features to:

• Identify, deanonymize, harass, threaten, or profile Message Senders.
• Generate unlawful, abusive, deceptive, infringing, or harmful Content.
• Make decisions that produce legal or similarly significant effects about another person without proper human review and lawful authority.
• Submit sensitive personal information unless necessary for the feature and lawful for you to provide.

We may limit AI usage, change AI models or providers, impose quotas, charge for AI features, block unsafe requests, and log usage metadata for safety, debugging, billing, abuse prevention, and service improvement.

FessBox may offer free and paid features. Paid features may include subscriptions, entitlements, premium analytics, additional pages, inbox exports, AI usage, reply tools, cards, or other functionality.

Subscriptions and in-app purchases made through an App Store are billed by that App Store and are subject to its terms, payment rules, cancellation rules, and refund policies. We do not control App Store billing decisions. To cancel, manage, or request a refund for an App Store subscription, use the subscription settings or support process provided by Apple, Google, or the applicable App Store.

Unless stated otherwise:

• Subscription fees are charged in advance.
• Subscriptions may renew automatically until canceled.
• Canceling a subscription stops future renewal but does not automatically refund prior charges.
• Paid features may remain available until the end of the paid period, unless terminated for violation of these Terms.
• Prices, plans, feature limits, trials, and entitlements may change, subject to applicable law and App Store rules.

If a subscription or entitlement does not activate properly, contact support@fessbox.com and, where applicable, the App Store that processed the purchase.

FessBox may provide tools to export account or inbox data and to request account anonymization or deletion. Some information may remain where necessary for legal compliance, app-store records, payment records, tax, fraud prevention, security, backups, dispute resolution, enforcement, or protection of other users.

You may stop using the Service at any time. If you want to close your account or request deletion, use the in-app tools where available or contact support@fessbox.com.

FessBox, including its software, designs, interfaces, features, branding, logos, trademarks, service marks, content created by us, and related intellectual property, is owned by us or our licensors and is protected by intellectual property laws.

These Terms do not grant you ownership of FessBox or any FessBox intellectual property. You may not use our name, logo, branding, or trademarks without our prior written permission, except as allowed by law.

If you submit ideas, suggestions, bug reports, or feedback, you grant us a worldwide, perpetual, irrevocable, royalty-free license to use, reproduce, modify, distribute, display, and otherwise exploit that feedback without restriction or compensation.

We respect intellectual property rights. If you believe Content on FessBox infringes your copyright or other rights, contact support@fessbox.com with:

• Your name and contact information.
• A description of the work or right you believe is infringed.
• The location or identifier of the allegedly infringing Content.
• A statement that you have a good-faith belief the use is not authorized.
• A statement that the information you provide is accurate and that you are the rights owner or authorized to act for the rights owner.
• Your physical or electronic signature.

Knowingly submitting false or misleading infringement claims may expose you to liability.

The Service may integrate with or link to third-party services, including Clerk, Supabase, Expo, Sentry, PostHog, RevenueCat, Google AI/Gemini, Apple App Store, Google Play, social platforms, and other websites or services.

We do not control third-party services and are not responsible for their content, policies, security, availability, billing decisions, or practices. Your use of third-party services may be governed by their own terms and privacy policies.

If you download FessBox from Apple App Store or Google Play, you also agree to the applicable App Store rules. The App Store provider is not responsible for providing support or maintenance for FessBox except as required by law. If these Terms conflict with applicable App Store terms, the App Store terms may control solely with respect to your relationship with that App Store.

We may modify, suspend, discontinue, limit, or remove any part of the Service at any time. We may release updates, bug fixes, security patches, or feature changes. You may need to install updates to continue using the Service.

We do not guarantee that the Service will always be available, uninterrupted, secure, error-free, compatible with every device or operating system, or that data will never be lost. You are responsible for maintaining your own copies of Content that you need outside the Service.

We may suspend or terminate your access to the Service, accounts, pages, Content, or features at any time if:

• You violate these Terms or our policies.
• Your use creates legal, safety, security, operational, reputational, or financial risk.
• We are required to do so by law, an App Store, a payment provider, or another platform rule.
• We discontinue the Service or a material part of it.

You may terminate your use by stopping use of the Service and requesting account closure where applicable.

Upon termination, your right to use the Service ends immediately. Sections that by their nature should survive termination will survive, including ownership, Content licenses, payment obligations, disclaimers, limitations of liability, indemnity, dispute provisions, and enforcement rights.

We do not warrant that:

• The Service will meet your expectations or requirements.
• Content, analytics, AI outputs, moderation results, or recommendations will be accurate, complete, safe, or suitable.
• Harmful, illegal, or unwanted Content will always be detected or removed.
• Anonymous messaging will prevent all identification in every circumstance.
• Data will never be lost, corrupted, delayed, or unavailable.

Some jurisdictions do not allow certain disclaimers, so some limitations may not apply to you.

To the fullest extent permitted by law, our total liability for any claim relating to the Service or these Terms will not exceed the greater of: (a) the amount you paid to FessBox for the Service in the 12 months before the event giving rise to the claim; or (b) USD $100.

Nothing in these Terms limits liability that cannot be limited under applicable law, such as liability for fraud, fraudulent misrepresentation, intentional misconduct, or death or personal injury caused by negligence where such limitation is prohibited.

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless FessBox and its service providers, affiliates, officers, employees, contractors, agents, and licensors from and against claims, damages, losses, liabilities, costs, and expenses, including reasonable legal fees, arising from or related to:

• Your use or misuse of the Service.
• Your Content.
• Your violation of these Terms.
• Your violation of law or third-party rights.
• Your use of AI outputs, public pages, replies, cards, exports, or social sharing.

This indemnity does not apply to the extent a claim is caused by our own unlawful conduct or where prohibited by applicable consumer law.

These Terms are governed by the laws of the Federal Republic of Nigeria, excluding conflict-of-law rules, except to the extent mandatory consumer protection laws in your jurisdiction require otherwise.

Before filing a claim, you agree to first contact support@fessbox.com and try to resolve the dispute informally. We will also try to resolve disputes informally where practical. If a dispute cannot be resolved informally, it may be brought before a court of competent jurisdiction, subject to any mandatory rights you have under applicable law.

To the extent the Service is subject to the European Union Digital Services Act or similar online safety laws, FessBox provides support@fessbox.com as a point of contact for users, authorities, and trusted flaggers where applicable.

Users and third parties may report illegal or policy-violating Content by contacting support@fessbox.com or by using in-app reporting tools where available. Reports should include enough information for us to identify the Content and understand the issue.

Where required by applicable law, we will provide statements of reasons for certain moderation decisions, offer available appeal or redress mechanisms, and publish or make available transparency information. These provisions apply only to the extent required by law and do not limit our rights to enforce these Terms.

We may update these Terms from time to time. We will update the effective date when we make changes. If changes are material, we will provide additional notice where required by law. Your continued use of the Service after updated Terms become effective means you accept the updated Terms. If you do not agree to updated Terms, stop using the Service.

These Terms and the Privacy Policy are the entire agreement between you and FessBox regarding the Service.

If any provision is found invalid or unenforceable, it will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in effect.

Our failure to enforce a provision is not a waiver of our right to enforce it later.

You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, sale of assets, or by operation of law.
